Thank you for the great site.I have 2 questions.I read where we can purchase game footage that Fox has for 30 dollars.My question is in what format will they be dubbed/shipped?

My second question is can you explain what happened to the Watervliet/Fonda football game

clip that Fox23 aired early Sunday morning October 18th.The game was from the 17th of October.I stayed up to catch it after the extra inning Yankees game,& Fox in fact had Fonda & Vliet,but when I checked this morning (10-18) on the site I cannot locate it.

Pot smokers showed a 65% reduced risk of head and neck cancers

Among the more interesting pieces of news that came out while I was on vacation the first half of August was a new study in the journal Cancer Prevention Research, which found that marijuana smokers have a lower risk of head and neck cancers than people who don’t smoke marijuana. Welcome back.. the 2007 season is almost ready to take off.. and so are we. We are well into the planning stages for another season of the FOX23 High School sports show, the original and only complete high school show in the Capital Region.

We'll be covering all the fall sports again this season with an emphasis on football and boys and girls soccer. But those aren't the only sports we cover. As you've seen in past years, we get to all the sports including field hockey, cross country, golf, tennis, swimming and volleyball.

As always, we're asking for your help. If you know of a story involving a Section II athlete, coach, official, fan, team.. well, Section II anything, we want to know. Please, post here at the forum or drop us an e-mail at sports@fox23news.com.

We'll also be adding a new wrinkle this year with our FOX BOX on-line poll question. We'll be asking you to pick our high school football "Game of the Week". Each week, we'll post a list of possibilities and ask you to vote for the one you think in the best matchup. Not only will we make that game the headliner, we will also post on our web site, soon after the game, all the footage we shot from that game, not just the highlights we showed during the show. Just a little added incentive for you to log on and make your schools game the headliner.

We'll also be continuing our "Team of the Week" feature as well as giving you medical advice from our trainer, Rick Knizek. ...and of course, we'll be bringing back the highly popular "Rockin' Rewind" plays of the week.

Bottom line, if you aren't watching, we don't have a show. So get involved! Let us know what you like and what you don't like. We'll make adjustments as we go.

Court overturns murder conviction

New trial ordered for ex-Marine reservist accused in fatal stabbing

ALBANY -- A former Marine reservist convicted of fatally stabbing a 20-year-old man two years ago will get a new trial, a state appeals court ruled Thursday.

Kevin Murphy, 28, has been serving a 25 years-to-life sentence at Upstate Correctional Facility in Franklin County for the April 30, 2006, slaying of Joseph Jerome during a street fight on Hudson Avenue.

But he'll get a new chance at a freedom following Thursday's ruling by the Appellate Division of state Supreme Court. It found evidence used to convict Murphy -- specifically a phone call he made to his family while being interviewed by police -- should not have been played, in its entirety, at trial.

On Thursday, the second anniversary of the killing, the midlevel court reversed the second-degree murder conviction and sent the case back for a new trial.

Murphy and Jerome did not know each other when their paths crossed after 1 a.m. the morning of the homicide. Albany County Assistant Chief District Attorney Mark Harris, who prosecuted the case, said in 2006 that Murphy "went after" Jerome after being punched in the mouth.

"But the other kid hadn't punched him," Harris added. "And he had nothing to do with punching him."

Police believed Murphy stabbed Jerome once in the chest outside Murphy's Hudson Avenue home that morning. Jerome had been living in Schenectady.

Murphy agreed to speak to police, but their interrogation stopped once he asked for a lawyer. Murphy then spoke to his father and sister on a police phone, and was told the line was being tape-recorded. The 14-minute conversation was used against him at trial, the Appellate Division noted.

While his request for an attorney did not make the evidence unfit for trial, he had repeatedly invoked his right against self-incrimination, the court said, continuing it was "unable to conclude that there is no reasonable possibility that the evidence regarding defendant's invocation of his rights contributed to his conviction."

In addition, the court noted evidence of Murphy's guilt at the trial was "not overwhelming."

Jerome, the father of a young boy, was killed in an area between the College of Saint Rose and the University of Albany's downtown campus. The neighborhood is home to scores of college students, many of whom frequent the bars on Madison and Washington avenues.

At his sentencing, Murphy told Judge Thomas Breslin he acted in self-defense. "I want you to know that Joseph was not killed in cold blood -- his death was an accident," he said. "I have served my country and when called upon to fight the war on terrorism and free the people of Iraq, I went ... now I'll be forced to live like an animal among animals. I ask you to look at the facts of this case."

His appeal was handled by Mitchell Kessler of Cohoes, who could not be reached Thursday. "The decision speaks for itself," said Heather Orth, a spokeswoman for Albany County District Attorney David Soares. "We'll move forward to prosecuting the case again."

Watched the promo for this special report. "We need to renew our license to drive, to own a dog, to go fishing...etc. But we don't have to renew our license for our guns."

Couple of points -

*Out of all the examples given, which actions ( dog owner, driver, fishing, etc.) are protected by the Bill of Rights in ourConstitution?

*Most of the firearms shown in the promo were long guns. They don't require any license in upstate NY....

*To acquire a handgun license in the Capital District one must take and pass safety classes. Pass an FBI investigation. Pass a review by local police. Provide multiple references of one's good character. Pay over $100 in non-refundable fees. Be finger printed and OK'd by the local County Judge. This takes in excess of 8 months to get through. One misdemeanor, one domestic disturbance, one hickup and the Judge pulls the license..........

Funding for Gilboa Dam Safety

As president of the watch dog organization of The Dam Concerned Citizens Inc. of Schoharie County, I would like to respond to the press release issued by the DEP yesterday afternoon.

Although we are pleased at their announcement, this is not a new and brilliant idea. We have been fighting for these concessions for months. At the Board of Supervisors meeting last month this organization presented testimonies from the State Assembly Hearing at SCCC in March and video of Dan Docktoroff, all documenting that statements were previously made by Commissioner Emily Lloyd, people on her staff, and Deputy Mayor Docktoroff regarding the use of flood gates,and paying for the siren warning system.
Our Board of Supervisors was also requesting these same things, as well as the siphons remaining in place during all construction, and not to remove the notch cut in the crest of the Dam. Any step forward gained with NYC and DEP is gladly welcomed, as it furthers our cause of safety for the residents living in the path of a potentially life threatening situation. These steps are only taken after much struggling and many fervant prayers. This is not the end of our fight for safety, now we continue pressing for a higher factor of safety, and legislation to hopefully prevent this from happening again to us or anywhere else in this country.
